A. Liability

1. I expressly assume all liability arising out of operation of the tools, equipment, and machinery at Shoppe and Tailor Studios, including the use of my own equipment while renting the studio space.

2. The risk of injury from the activities involved in using the studio space is minimal but not none. These risks include but are not limited to: Equipment failure and/or malfunction, needle breakage, possibilities of injury relating to the use of sharp object such as pins, needles, scissors, rotary cutters, and OLFA knives.

I agree to wear and use as instructed any safety equipment provided to me.

I recognize that failure to do so increases the potential for injury and absolves the (RELEASEES) from any liability.

I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, and assume full responsibility for my reasonable use and operation of equipment within Shoppe and Tailor studios.

3. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS Shoppe and Tailor Ltd, its officers, officials, agents and/or employees, other participants, sponsors, advertisers, and, if applicable, owners and lessors of premises used (RELEASEES), from any and all claims, demands, losses, and liability arising out of or related to any injury, disability or death I may suffer, or loss or damage to person or property,

Whether arising from negligence of the releasees or otherwise, to the fullest extent permitted by law.

B. Safety and operation of equipment

1. I will read any and all Safety manuals presented to me or available for my perusal through the studio, including Machine

Manuals, MSDS sheets, and other precautionary instructions.

2. I understand that Closed-toe shoes are required for working within the studio. No flip-flops or sandals are allowed.

3. I understand that Shoppe and Tailor Studios recommends bringing indoor shoes during wet or snowy weather for safe operation of machines and usage of space (tile floors can be slippery), and I will do this or use a pair of the studio's provided indoor shoes during my rental.

4. Shared Tool Policy - All shop tools used must be returned to their storage homes at the end of each work day, including threads, with no exceptions. If I am unsure how to correctly & safely use a tool provided at the studio, I will ask a staff member prior to use. I will not hold Shoppe and Tailor Ltd. responsible in the event of accident or injury resulting from the misuse of studio equipment.

5. Personal Tools: I understand that S&TS encourages me to label my personal tools and keep them stored securely. I understand that I bring my own tools at my own discretion. Shoppe and Tailor Ltd will not be held responsible for the loss, damage of, or injury resulting from misuse of personal tools while in the studio. I will not use others' personal tools withoutpermission.

C. Entire agreement and disputes.

1. This agreement contains the entire understanding between and among the parties and supersedes any prior understandings

and agreements among them respecting the subject matter of this agreement.

TERMS & CONDITIONS

For all intents and purposes, throughout this agreement, "I" refers to the customer, the user, and the producer/production

company if applicable; also "Shoppe and Tailor Studios" shall hereafter be referred to as "S&TS". Further, the “Rental Period”shall include the time from the moment when the makers begins their rental until their booked time is up, or their add-on rental extension is over.

I, the undersigned, in consideration of renting makerspace from Shoppe and Tailor Studios, state that I have read and understand and hereby expressly accept and agree to the above and following terms and conditions:

A. Payment and Cancellation Policies.

1. I agree to pay upon booking all rates, charges, plus applicable taxes, fees and surcharges, which may apply to the rental.

Iagree and understand that there may be service fees associated with last-minute cancellations

2. Clients who fail to show up for a rental booking will not be refunded.

3. Short-term rental cancellations may be made up to 24 hours in advance of booking time for full refund.

We are happy to reschedule for the future, pending studio availability. Last minute or no-show Full day/Half-day rental cancellations may be subject to a $20 late cancellation fee

4. Weekly Rentals: may cancel/reschedule up to 5 business days prior to booking time for full refund. Last-minute cancellations/rescheduling are subject to a $75 fee.

5. Monthly Rentals: may reschedule/cancel up to 10 business days prior to booking time for full refund. A 15% last-minute cancellation fee will be charged for less than 10 business days notice.

6. Memberships: Membership bookings may be rescheduled for a future date up to 12 hours in advance of your booking. No-show appointments will not be rescheduled. Membership bookings not used by the end of the 30-day period are not transferable and do not rollover into the next month. Members’ 10% or 15% discount code expires at the end of the 30-day period.

7. Workshop Rentals: Workshop rental bookings may be canceled up to 48 hrs in advance for full refund. If you paid for your booking by credit card or via Square, there is a 3% cancellation fee. Cancellations with less than 48 hrs notice are subject to a 50% cancellation fee.

B. Privacy Policy.

1. Shoppe and Tailor Ltd doesn't share personal information such as names, pronouns, address, and phone number with

anyone. We save it for contact purposes and our records.

C. Entire agreement and disputes.

1. This agreement contains the entire understanding between and among the parties and supersedes any prior understandings

and agreements among them respecting the subject matter of this agreement.

2. In the event a suit or action is brought by any party under this agreement to enforce any of its terms, or in any appeal

therefrom, it is agreed that the prevailing party shall be entitled to reasonable attorney’s fees and costs.
